GENERAL TERMS AND CONDITIONS
Munich-Milan-Gravel Challenge 2026
§1 Application – Validity
- The Munich–Milan Gravel Challenge (hereinafter referred to as “MMG” or “the Event”) is an event organized by Schuberth & Rotter GbR, Sandrartstraße 26, 80687 Munich, Germany (hereinafter referred to as “the Organiser”).
- These General Terms and Conditions (“GTC”) are published at https://we-are-cyclists.de/events/munich-milan-gravel/ and form part of the contract between the Organiser and the participant in the version valid from the date of signature.
- By registering for the Event, the participant accepts these GTC in full. A separate Liability Waiver and Consent & Data Agreement must additionally be signed by the participant during the accreditation in person.
- These GTC, together with the Liability Waiver and Consent & Data Agreement signed at accreditation, supersede and replace all previously issued versions of these documents that were handed out and signed by participants during the registration process in connection with Munich-Milan-Gravel. Only the current versions shall be legally effective.
§2 Conditions of Participation – Safety Measures
- Participation in MMG is open to healthy, experienced, and well-trained individuals who have reached the age of 18 at the time of the Event. Each participant bears full personal responsibility for their state of health and fitness. Participants must be fully aware of the distance, terrain, and conditions of the Event – including night riding, cold temperatures, possible snow, rain, wind, and high altitude – and must prepare accordingly.
- Anyone who has completed registration in full and is in possession of an official Follow My Challenge (FMC) tracker assigned by the Organiser may take part.
- Organisational measures and instructions will be communicated to participants before the start of the Event. The instructions of the Organiser and their appropriately marked personnel must be followed at all times. In the event of violations that could disrupt the orderly course of the Event or endanger the safety of participants or third parties, the Organiser is entitled to exclude or disqualify the person concerned at any time.
- All regulations, instructions, and guidelines contained in these GTC and in supplementary event documents constitute direct contractual obligations. Claims of any kind in connection with the contract must be asserted against Schuberth & Rotter GbR in writing within one month of the contractually stipulated end of the Event.
- MMG starting criteria – participants must:
- hold valid international insurance covering emergency extraction (search & rescue) and repatriation;
- have submitted a signed copy of these GTC (digital or in person), the Liability Waiver and the Consent & Data Agreement in person;
- if required, submit a medical certificate as specified by the Organiser to comply with applicable regional guidelines;
- have joined the official Event communication channel (WhatsApp group) for communications during the Event. Participants who have not joined the official Event communication channel may not receive important communications in good time, or at all.
Participants who have not fulfilled all starting criteria will not be permitted to start.
§3 Registration – Confirmation – Payment – Refunds
- Registration takes place via the ticketing provider Njuko. Registration is binding upon the participant. Once registration has been completed in full, participants will receive a confirmation.
- The ticketing provider’s own terms and conditions apply to the registration and payment process.
- Entry tickets may be transferred to another eligible participant, subject to prior written approval by the Organiser. Any transfer request must be submitted in writing to munichmilangravel@we-are-cyclists.de. The Organiser reserves the right to decline any transfer request at its sole discretion.
- Any participant who receives a transferred ticket must sign the registration form provided by the Organiser. They must additionally sign to confirm acceptance of these GTC, the Liability Waiver, and the Consent & Data Agreement. Participation is not possible without this consent.
- The Organiser will send registration confirmation to the participant.
- The Organiser reserves the right to disqualify and/or exclude a participant at any time if the participant has provided false personal data during registration.
- Starting documents will only be issued upon submission of a signed Liability Waiver. The participant must collect their tracking device and sign the Liability Waiver in person at accreditation.
- The Organiser may exclude a participant from the Event or terminate the contract if the participant:
- violates the Event rules or instructions (before or during the Event);
- persistently disrupts the Event or endangers themselves or others;
- fails to follow the instructions of the Organiser or Event staff;
- behaves in a manner contrary to the contract to such a degree that immediate termination is justified.
- The following cancellation and refund conditions apply:
- Full refund for all cancellations received in writing no later than 30 April 2026. Written notice must be sent to munichmilangravel@we-are-cyclists.de.
- After expiry of this deadline, the entry fee will not be refunded under any circumstances, as the Organiser will have committed to fixed costs that cannot be recovered.
- Refunds will be processed within 14 working days of receipt of a valid written cancellation.
- Cancellation by the participant must be made in writing to munichmilangravel@we-are-cyclists.de.
§4 Cancellation of the Event – Force Majeure – Non-Participation
- If the Event, or individual sections of the route, are cancelled due to force majeure – including but not limited to extreme weather, natural disasters, pandemics, government orders, or other circumstances beyond the Organiser’s reasonable control – the participant is not entitled to a refund or proportional refund of the participation fee, nor to compensation for consequential damages such as travel or accommodation costs
- If a registered participant fails to appear at the start, no refund of the participation fee is due.
- The Organiser shall not be liable for any reduction in or prevention of participation resulting from legal regulations or official orders imposed on the participant.
§5 Exclusion of Liability – Indemnity
- By completing registration, the participant bindingly confirms – without further examination by the Organiser – that they possess the special prior experience and skills specified in §2 of these GTC and in the Liability Waiver.
- Claims for damages by the participant against the Organiser are excluded to the fullest extent permitted by mandatory law. This exclusion does not apply where the Organiser, its legal representatives, or vicarious agents:
- have acted with intent or gross negligence;
- are liable for injury to life, body, or health;
- have breached essential contractual obligations through ordinary negligence, in which case liability is limited to typical, foreseeable damages.
- The participant agrees to indemnify and hold harmless the Organiser, its employees, volunteers, and agents against any third-party claims arising from the participant’s own conduct, equipment, or participation in the Event, unless the Organiser bears mandatory liability under paragraph (2) above.
- The participant agrees to submit to any reasonable checks concerning their person, fitness, and equipment as ordered by the Organiser or Event officials.
- The participant is fully aware of and accepts the conditions of participation and applicable regulations. The participant expressly confirms they have read, understood, and accepted all rules, regulations, and conditions.
- The participant declares that they participate at their own risk and that they are adequately insured for the Event, including coverage for accidents abroad.
- The Organiser assumes no liability for health risks arising from participation. At the start, the participant confirms that there are no health concerns that would preclude participation and that their fitness level meets the demands of an alpine endurance challenge.
- The Organiser accepts no liability for lost valuables, clothing, or equipment, nor for items during luggage transport (clothing bags, drop bags, etc.), except as required by mandatory law.
- If third parties are engaged by the participant or by the Organiser acting on the participant’s behalf – for example in the event of rescue services being alerted – the costs incurred are to be borne by the participant, and the Organiser reserves the right to recover any such costs it has advanced.
- It is strongly recommended that participants hold private international health insurance that covers helicopter rescue missions and repatriation.
§6 Data Protection – Photography – Media
- The Organiser processes personal data provided during registration exclusively for the purposes of organising and running the Event, including participant management, payment processing, emergency coordination, and GPS tracking. Data is processed in accordance with applicable data protection law, in particular the EU General Data Protection Regulation (GDPR).
- Full details of the categories of data processed, the legal bases, data recipients, international transfers, retention periods, and participants’ rights are set out in the separate Consent & Data Agreement, which participants are required to read and sign. In the event of any conflict between this section and the Consent & Data Agreement regarding data protection matters, the Consent & Data Agreement shall prevail.
- The participant agrees that photographs, video recordings, and audio recordings made in connection with their participation in the Event may be used by the Organiser and their partners for non-commercial event documentation and promotion, including publication on the Event website, social media channels, and other media platforms operated by the Organiser (such as Instagram, Facebook, YouTube, and we-are-cyclists.de) or their partners. No remuneration is payable for such use. The participant may withdraw this consent for future use at any time by contacting munichmilangravel@we-are-cyclists.de.
- The participant agrees to the publication of their name, nationality, and finishing time in all printed and electronic media relating to the Event.
- The participant may object to the disclosure or publication of their personal data by notifying the Organiser in writing at munichmilangravel@we-are-cyclists.de.
- By providing their e-mail address, the participant agrees that Schuberth & Rotter GbR may use it to send event-related information.
§7 Statute of limitations
- Claims by the participant against Schuberth & Rotter GbR, regardless of legal grounds, expire one year after the contractually agreed end of the Event, unless mandatory statutory limitation periods apply.
- The entire legal and contractual relationship between Schuberth & Rotter GbR and the participant is governed exclusively by the law of the Federal Republic of Germany, excluding conflict of laws provisions.
- The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Munich, Germany, to the extent permitted by applicable law.
